Welcome to DriftWise ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our application, website, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Services Provided

We offer AI-generated fishing condition reports based on data sourced from public services, including the National Weather Service (NWS), United States Geological Survey (USGS), and United States Naval Observatory (USNO). Users can generate a limited number of reports for free or purchase a subscription.

2. Accuracy of Information

While we strive to provide accurate and timely information, the data and reports are generated based on publicly available information and predictive models. We do not guarantee the accuracy, completeness, reliability, or suitability of any report. Use the reports at your own discretion and risk.

3. Purchases and Refunds

Each account includes 3 free reports. You may also choose to subscribe to a monthly plan, which provides up to 100 reports per month for a recurring fee of $5/month. All purchases and subscriptions are final and non-refundable unless otherwise required by applicable law. You may cancel your subscription at any time; once the current billing cycle ends, your account will automatically revert to the free tier with access to 3 free reports.

4. User Conduct

You agree not to:

  • Use the Services for any unlawful purpose.
  • Attempt to access or interfere with our systems or networks without authorization.
  • Resell, redistribute, or otherwise exploit any content from the Services without our written permission.

5. Intellectual Property

All content, including generated reports, branding, and design elements, are owned by DriftWise or licensed to us. Your use of the Services does not grant you ownership of any intellectual property rights.

6. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied.

7. Limitation of Liability

We are not liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits or revenues, resulting from your use of or inability to use the Services.

8. Changes to Terms

We may modify these Terms at any time. Your continued use of the Services after changes constitutes acceptance of the new Terms.

9. Governing Law

These Terms are governed by the laws of the State of Pennsylvania, without regard to conflict of law principles.
